1.1. MyLoads (Pty) Ltd (“the Company”, “MyLoads”, “we”, “us” or “our”) is committed to protecting and respecting your privacy. This Privacy Policy (“Policy”) explains how we collect, process, and safeguard personal information of data subjects (“you”) who interact with our platform.

1.2. We comply with the Protection of Personal Information Act (POPIA), Act 4 of 2013.

• (a) consent to this Policy and authorise us to process such information as outlined;

• (b) authorise MyLoads, its service providers, and business partners to process your information for the purposes set out in this Policy.

1.4. We will not use your information for purposes other than those specified in this Policy and will protect it from unauthorised alteration, loss, or disclosure.

1.5. This Policy applies to all data subjects interacting with MyLoads, including Shippers, Transporters, prospective employees, contractors, service providers, regulators, and any persons acting in a representative capacity.

2. Collection of Personal Information

2.1. We collect and process personal information mainly to provide access to our services and improve our offerings.

2.2. We collect personal information directly from you when you register, post loads, submit quotations, request services, or communicate with us.

2.3. Website usage data may be collected using cookies (see section 13).

2.4. We do not knowingly collect personal information of children without the consent of a competent person.

3. Categories of Personal Information We May Process

We may collect and process the following types of personal information:

• Contact details (name, address, phone number, email),

• Business registration and verification details (for Transporters),

• Transactional data (load postings, quotations, bookings, payments),

• Banking/payment details for escrow deposits and payouts,

• Device and browsing data (IP address, browser, OS, preferences),

• Consent records (opt-ins, POPIA consents, timestamps),

• Employer or business details when engaging in a corporate capacity.

4. Special Personal Information

We will only process special personal information (such as sensitive ID or financial data) when required by law, with your consent, or where necessary for legitimate business purposes (e.g., KYC/AML compliance for payouts).

5. Purposes of Processing and Legal Bases for Processing

We will process your information for purposes including:

• Operating our marketplace and escrow services,

• Enabling Shippers to post loads and Transporters to submit quotes,

• Facilitating secure payments, refunds, and payouts,

• Conducting KYC/AML checks,

• Responding to enquiries and support requests,

• Fraud prevention and system security,

• Compliance with regulatory obligations,

• Monitoring and improving platform performance,

• Direct marketing (subject to your consent).

6. Disclosure of Personal Information to Third Parties

We may share information:

• With trusted service providers (payment processors, IT support, compliance partners),

• With regulators and law enforcement when legally required,

• With contractors bound by confidentiality agreements,

• With third parties involved in fraud prevention or security investigations.

We will ensure that such parties process your data only for the purposes agreed and with adequate safeguards.

If data is transferred outside South Africa, this will only occur where the receiving country or service provider ensures protection standards substantially similar to POPIA, or where you have consented to such transfer.

We will limit the personal information we collect and process to what is strictly necessary for legitimate business purposes.

11. Data Retention

Personal information will only be retained for as long as necessary to fulfil its purpose or comply with legal requirements, whichever is longer.
